Inspector Notes

An unannounced complaint investigation was conducted on 4/15/2024 from 7:40am-9:15am in response to complaints received on 4/8/2024 and 4/12/2024. The complainants stated that classrooms frequently run over the maximum allowable ratios most mornings and on the morning of 4/8/2024 one of the staff member was supervising 10 children (2 children over the maximum allowable supervision guidelines) when a child was injured and required outside medical care.

The investigation included a review of incident reports, 3 staff records, 1 child's record, and interviews with multiple staff, the management team, and the owners. A preponderance of the evidence supports the claims made by the complainants, and the complaint is deemed to be valid.

SYSTEMIC DEFICIENCY

Based on interviews and record review, staff did not ensure the care and protection of children in care.
Evidence:
1. On the morning of 4/8/2024 Staff 1 was in the Two year old classroom supervising 10 children. The maximum allowable child to staff ratio for a two year old grouping is 8 children to 1 staff member.
2. At 9:10 am on 4/8/2024 Child 1 (age 2) fell, hitting their head on a bookcase.
3. Staff 1 did not have the required CPR and First Aid training to be supervising children alone.
4. Child 1 required 6 stitches to their forehead for the sustained injury.

SYSTEMIC DEFICIENCY

Based on record review, and interviews, a ratio of one caregiver for eight children was not followed in classrooms for children aged 24 months to 3 years old.
Evidence:
1. Staff statements and written reports confirm the two year old classroom was out of ratio with 1 staff for 10 children the morning of 4/8/2024.
2. Multiple interviews confirmed that the ratio has been consistently out of compliance most mornings in the preceding weeks.

Standard 8VAC20-780-530-A
Based on record review and interviews, at least one staff in each classroom where children are present did not have a current certification in cardiopulmonary resuscitation (CPR) and First Aid.
Evidence:
On 4/22/2024 Staff 1 was the only staff present in the room with 10 two year old children (two children over the maximum supervision guidelines) when Child 1 fell, hitting her head on a bookcase which resulted in the need for stitches on their forehead. Staff 1 did not have a CPR or First Aid certification on the date of the incident.
