Inspector Notes
An unannounced inspection was initiated on 08/14/2024 and completed on 08/20/2024 in response to complaints received by the licensing office relating to allegations of staff-to-children ratio requirements. This inspection included documentation review, observations, and interviews.
The preponderance of evidence gathered during the investigation supports the allegations; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 08/30/2024. A POC submitted after this date will not appear on the public website.
Violations
7Evidence:
On 08/14/2024, at approximately 3:36 licensing inspector entered the Infant 3 classroom and observed no staff in the classroom and there was a 10-month-old infant asleep in a crib and a 2-year-old child sitting in an adaptive wheelchair. The exterior door of the classroom to the playground was open. The staff returned to the classroom within a minute of the licensing inspector entering the classroom. Staff acknowledged she had stepped out of the classroom to the playground.
To ensure that this teacher and all infant staff have re-visited the Infant policies and procedures. Including re-visiting the sleep safe requirements. As well as revisiting the licensing requirements from the VADOE.
Based on observation, interview, and documentation, the center did not ensure compliance with ratios of staff to children as required.
Evidence:
1. Licensing inspector entered the Infant 3 classroom at approximately 2:09 p.m. on 08/14/2024 and observed 1 staff supervising 8 infants. The staff acknowledged the room was out of the 1 staff to 4 children ratio when the licensing inspector entered the room and earlier in the day.
2. Licensing inspector reviewed the Infant 3 classroom Child Supervision Record (CSR) dated 08/14/2024. The CSR documented the child to staff ratio:
7:55 a.m. 7 infants/1 staff
8:57 a.m. 7 infants/1 staff
10:30 p.m. 10 infants/2 staff
12:10 p.m. 9 infants/2 staff
2:10 p.m. 8 infants/1 staff
3. Licensing inspector entered the Infant 2 classroom at approximately 2:46 p.m. on 08/14/2024 and observed 1 staff supervising 11 infants. The staff acknowledged she had been alone in the classroom since 2:30 p.m. when 2 staff left for the day and this was not an isolated event. The Infant 2 classroom was out of ratio for fifty-one minutes. The licensing inspector observed the following staff-to-infant ratio in the room:

3:11 p.m. 10 infants/1 staff
3:16 p.m. 10 infants/2 staff
3:21 p.m. 9 infants/2 staff
3:42 p.m. 8 infants/2 staff
The room came into ratio at 3:42 p.m.
4. Licensing inspector reviewed the Infant 2 classroom Child Supervision Record (CSR) dated 08/19/2024. The CSR documented the child to staff ratio:

8:13 a.m. 15 infants/3 staff

A. Call parents to pick up their children if we can not adhere to ratio requirements
B. Re-visit teachers' schedules making sure all staff know their schedules and where they need to be on a daily basis.
C. Close classrooms and call parents to pick up when we do not have enough teachers to ensure we are not out of ratio.
Evidence:
Licensing inspector observed the Toddler 1 classroom on the playground at approximately 3:51 p.m. on 08/14/2024 with 6 toddlers and 1 staff supervising. The staff acknowledged that her class had been out of the required 1-to 5 ratio for most of the day due to her co-teacher assisting in other classrooms.
AD to step into classrooms to assist with ratios.
Evidence:
1. Licensing inspector observed the DPS 2 (2-year-old) classroom at 9:49 a.m. on 08/20/2024 with 23 children and 2 staff supervising. Classroom staff acknowledged that the classroom was over the required 1-8 ratio. Staff reported the 3rd staff in the classroom had left the classroom to use the restroom.
2. Licensing inspector observed the DPS 2 (2-year-old) classroom at 9:54 on 08/20/2024 with 9 children and 1 staff supervising. Classroom staff acknowledged that she had nine children and the required ratio is 1-8.
Move the child in the DPS2 class who is 3 and is currently completing some
light transitions to the preschool room until the end of September.

Evidence:
Licensing inspector observed the Pre-K (4-year-old) classroom at 9:41 a.m. on 08/20/2024 with 12 children and 1 staff supervising. Classroom staff acknowledged that the classroom was over the required 1 to 10 ratio.
Inform parents of teacher schedule changes due to sickness, lateness etc.
Ad to step into classrooms to assist with ratios.

Licensing inspector observed on 08/14/2024 multiple children in the Infant 2 classroom did not have their hands washed after their diaper were changed.
Evidence:
Licensing inspector observed multiple children on 08/14/2024 in the Infant 1 and Infant 2 rooms walking around the classroom and drinking from bottles and cups.
