Inspector Notes

An unannounced monitoring inspection was conducted with the director from 12:10 pm to 2:25 pm. There were 40 children present with 11 staff providing supervision. The ages of the children ranged from 4 months to 5 years. During the classroom walkthrough, the children were eating lunch, which consisted of cheese pizza, green beans, banana and milk. Medications for 5 children were reviewed as well as 2 allergy care plans. A sample size of 6 injury/accident reports were reviewed as well as five staff and five children's files were reviewed. The areas of noncompliance is outlined on the violation notice.

Repeat Violation:
Based on observation and interviews, it was determined that a contract worker was alone with a child, therefore functioning as an employee of the center, however this person did not have a Fingerprint background check on file, which is required upon hire/functioning as an employee.
Evidence:
Person A has been acting as an employee since December 2023, however these was no fingerprint background check on file.
Plan of Correction: Upon knowing this, the contract worker has not been alone unsupervised with children. All necessary items are now on file for the contract worker.
Standard 8VAC20-770-60-B
Based on observation and interviews, it was determined that a contract worker was alone with a child, therefore functioning as an employee of the center, however this person did not have a Sworn Disclosure background check on file, which is required prior to hire/functioning as an employee.
Evidence:
Person A has been acting as an employee since December 2023, however these was no sworn disclosure statement on file.
Plan of Correction: Upon knowing this, the contract worker has not been alone unsupervised with children. All necessary items are now on file for the contract worker.
Standard 8VAC20-770-60-C-2
Based on observation and interviews, it was determined that a contract worker was alone with a child, therefore functioning as an employee of the center, however this person did not have a central registry background check on file, which is required within 30 days of hire/functioning as an employee.
Evidence:
Person A has been acting as an employee since December 2023, however these was no central registry background check on file.
Plan of Correction: Upon knowing this, the contract worker has not been alone unsupervised with children. All necessary items are now on file for the contract worker.
Standard 8VAC20-780-70
Based on observation and interviews, it was determined that a contract worker was functioning as an employee but the center had not established a file on this person.
Evidence:
Person A was observed alone with child A. Interviews revealed that the contract worker is intermittently alone with the child at the center anytime between 9 am to 3pm on a daily basis. Consequently, Person A was functioning as an employee but there was no file established for this person.
Plan of Correction: Upon knowing this, the contract worker has not been alone unsupervised with children. All necessary items are now on file for the contract worker.
