Inspector Notes

An unannounced monitoring inspection was initiated on 11/5/2025 and completed on 11/24/2025 in response to a self-report received by the licensing office on 10/28/2025 relating to supervision and care and protection of children. This investigation was conducted jointly with the Child Protective Services agency. The inspector reviewed 3 child records and 2 staff records on-site on 11/5/2025. This inspection included document review, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable
standards or law, and violations are documented on the violation notice issued to the program.

**REPEAT VIOLATION**
The child day center is required to obtain a copy of the results of a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.

Staff A did not have documentation on file of the results of a search of the child abuse and
neglect registry or a sex offender registry check for a state in which the staff member resided in the preceding five years. This is a repeat violation.

When staff are supervising children, they are required to always ensure their care, protection, and guidance.

When transitioning 10 children from the playground on the 4th level of the building to the 2nd level of the building where their classroom is located, Staff A left 3 of the 10 children on the elevator and the doors closed. The elevator then went down to the first floor, which is the lobby of the childcare facility. Staff B heard the children knocking and opened the door, helped calm the children and returned them to their classroom. For approximately 30 seconds, Child A, Child B, and Child C were not under direct supervision of any staff member and staff could not ensure their care and protection during this timeframe.

Children under 10 years of age are required to always be within actual sight and sound
supervision of staff.

On 10/27/2025, shortly after 11:30am, Staff A was outside on the playground located on the 4th floor/level of the building. Staff A began to transition the 10 children in Staff A's care into the elevator to go back to the 2nd floor where their classroom was located. Staff A got all 10 children in the elevator and arrived on floor 2. When the doors opened, multiple children began to run down the hallway towards the classroom. Staff A tried to keep a foot in the elevator to keep the door from closing, but Staff A's foot slipped and the door to the elevator closed with 3 children still inside. Staff A pushed the button twice for the doors to open, but they did not open. Staff A stated that they did not have a way to contact management at that moment and began following the children going down the hallway towards their classroom.

Approximately 30 seconds later, Staff B, who was sitting at the front desk area in the lobby heard children banging on the wall and calling out from the elevator on the 1st floor. Staff B opened the elevator door and found the 3 children (Child A, Child B and Child C) that were left behind. Two of the children were crying as Staff B reassured the children that they were safe. Staff B then returned the 3 children to the classroom where Staff A was.
