Inspector Notes
An unannounced investigation was initiated on 8/8/24 and completed on 9/27/24 in response to a complaint received by the licensing office on 8/5/24 relating to allegations of supervision and background checks. The inspector reviewed 6 children?s records and 2 caregiver records on-site on 8/8/24. The inspection included document review, tour of the home, interviews, and observations.
The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 10/22/24. A POC submitted after this date will not appear on the public website
Violations
13Caregiver#1, employed for more than two months, did not have documentation requesting a central registry check or sex offender registry check from a different state lived in within the proceeding 5 years.
There was no documentation of a central registry check, or that one had been requested within 7 days of hire, in the record for caregiver #1. The caregiver had been employed for more than 60 days.
The record for caregiver #1 did not contain the date of hire, documentation of two or more references, background checks as required by 8VAC20-770, documentation of the education and training as required by 8VAC20-800-230 and the name address and telephone number of a person to be notified in an emergency.
There was no documentation of the arrival and departure of the substitute provider, caregiver #1. The caregiver stated that she worked two weeks out of the month for the provider while the provider worked at her other job.
The provider stated the substitute provider, caregiver #1, worked in April and May.
The TB documentation in the record for caregiver #1 showed it was completed 56 days after the caregiver began employment and came into contact with children.
There was no documentation of the education or programmatic experience in the record for caregiver #1.
Children under two years of age, and children over two year of age who are not developmentally ready to climb or descend stairs without supervision shall not have access to stairs.
There was no gate in use to prevent access to the staircase. The provider had placed the gate against the wall and put a table against it. Children under two years of age were observed walking in the hallway and had access to the stairs.
Infants #5 and #6 were observed in cribs that did not have tight-fitting sheets. There were loose fleece blankets tucked around the mattress.
No soft bedding of any kind shall be used under or around infants including, but not limited to, pillows, quilts, comforters, sheepskins, or stuffed toys.
Infants #5 and #6 were observed in cribs with a comforter, a thick blanket and pillows.
When the inspector entered the family day home there were 6 children in care for a total of 20 points with only one assistant caregiver. Based on the points 2 caregivers were required.
The provider shall obtain the parent?s written acknowledgement of the receipt of all required information.
The records for child #1, child #2 and child #3 did not contain parental acknowledgement that the provider did or did not have liability insurance.
The records for child #1, child #2 and child #3 did not contain parental acknowledgement that the parent was informed of the family day homes emergency preparedness plan.
The records for child #1, #2, #3, #5 not contain parental acknowledgement for the family day home to notify the parent when a child becomes ill and for the parent to arrange to have the child picked up as soon as possible if so requested by the home.
Within seven business days of the child?s first day of attendance at the family day home, the provider shall obtain from the parent, verification of the identity and age of the child.
There was no documentation that the provider verified the identity and age of child #2.
Before a child may attend the family day home, the provider shall obtain documentation that the child has been adequately immunized according to the requirements of 31.1-46 A of the Code of Virginia and applicable state board regulations.
The records for child #1 and #3, did not contain documentation that the children were adequately immunized.
