Inspector Notes

A monitoring inspection, resulting from a self-reported incident received on 01/12/2024, was conducted 01/22/2024. The inspector reviewed video footage, 1 child record and 1 staff record, and interviewed 4 staff members.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Standard 8VAC20-780-340-A
Based on the review of video footage, the center failed to ensure that when staff are supervising children, they shall always ensure their care, protection and guidance.

Evidence: Video footage shows Staff 1 sitting in a chair in front of 3 children that were seated in highchairs. Child 1 (7 months old) can be seen falling forward out of the highchair, striking their head on a small refrigerator, landing on their face and shoulder on the floor, and coming to rest on their face/stomach; Child 1 immediately began to cry. The tray of the highchair had not been placed on the highchair nor had Child 1 been strapped into the highchair. Child 1 fell approximately 23 inches from the seat of the highchair to the floor. Staff 1 did not ensure the care and protection of Child 1 when she did not place strap the child into the highchair.
Plan of Correction: The center purchased floor chairs with trays for meals. Protocol for strapping children in will be created and reviewed with staff.
Standard 8VAC20-780-570-A
Based on the review of video footage, the center failed to ensure that when a child is placed into an infant seat or highchair, the protective belt shall be fastened securely.

Evidence: Video footage shows Child 1 (7 months old) falling forward out of a highchair, striking their head on a small refrigerator, landing on their face and shoulder on the floor, and coming to rest on their face/stomach. The protective belt of the highchair had not been securely fastened around Child 1.
Plan of Correction: The center purchased floor chairs with trays for meals. Protocol for strapping children in will be created and reviewed with staff.
