Inspector Notes

An unannounced complaint inspection was conducted on 12/19/2023 in response to allegations received by the licensing office on 12/15/2023 in the areas of background checks, Administration, Staff Qualifications and Training, Staffing and Supervision, and Special Services. There were 71 children, ages 16 months -9 years, and 13 staff providing direct care and supervision to children present during the inspection. Staff were interviewed and a total of 5 children?s records, 8 staff records, and additional documents were reviewed. The inspector arrived for the inspection at approximately 6:00 am and departed approximately 11:00 am.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

The information gathered pursuant to an investigation of the complaint supports the allegation and the complaint was determined to be valid.

Standard 22.1-289.035-B-2
Based on record review, the center failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint background check as required by the Code of Virginia.

Evidence: Staff 3 had a hire date of 11/27/2023. There was no eligibility letter available for review. Staff 3 was observed working during the inspection.
Plan of Correction: Has been requested. Waiting for results.
Standard 8VAC20-770-60-B
Based on record review and interviews with staff, the center failed to ensure that an employee must not be employed until the agency has the person?s completed sworn statement or affirmation.

Evidence: Staff 4 confirmed the hire date for Staff 8 was 11/14/2023. The sworn statement was dated 11/16/2023.
Plan of Correction: Provider will obtain before hire.
Standard 8VAC20-780-160-A
Based on record review, the center failed to ensure that each staff member shall submit documentation of a negative tuberculosis screening at the time of employment and prior to coming into contact with children.

Evidence:
1. Staff 1 had a hire date of 10/09/2023. The date on the tuberculosis screening in the record was 10/10/2023.
2. Staff 2 had a hire date of 10/09/2023. The date on the tuberculosis screening in the record was 10/10/2023.
3. Staff 4 had a hire date of 10/09/2023. The date on the tuberculosis screening in the record was 10/10/2023.
4. Staff 6 had a hire date of 10/15/2023. The date on the tuberculosis screening in the record was 10/16/2023.

Standard 8VAC20-780-240-B
Based on record review, the center failed to ensure that staff shall complete orientation training prior to the staff member working alone with children and no later than seven days of the date of assuming job responsibilities.

Evidence:
Staff 3 had a hire date of 11/27/2023. Orientation was completed on 12/13/2023 which is more than 7 days of assuming job responsibilities.
Plan of Correction: Provider will provide orientation during the required timeframe.
Standard 8VAC20-780-70
Based on record review, the center failed to ensure that staff records contain all of the elements as required by the standards.

Evidence:
1. Staff 3 had a hire date of 11/27/2023. The record for Staff 3 contained two reference checks dated 11/28/2023. Documentation that two or more references as to character and reputation as well as competency were not checked before employment.
2. The record for Staff 8 did not contain the date of employment.
Plan of Correction: Provider will obtain information as required by the standards.
