Inspector Notes

An announced monitoring inspection was initiated on 3/5/2026 and completed on 3/10/2026 in response to a self-report received by the licensing office on 3/5/2026 relating to care of a child. The inspector reviewed 1 child?s record and 1 staff record. This inspection included document review, interviews, and observations

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations have been cited related to information submitted by the facility of a report of an injury to a child while under the supervision of the facility that required outside medical treatment. Please see the Violation Notice for more details.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Standard 8VAC20-780-280-G
If hazardous substances are not kept in original containers, the substitute containers shall clearly indicate their contents and shall not resemble food or beverage containers.

A melamine sponge/foam abrasive cleaner was not kept in the original container and the sponge was not labeled with the contents. The original packaging lists "avoid accidents, do not use on skin or other parts of the body. Using on skin will likely cause abrasions." On 3/4/2026, staff #1 used the melamine sponge/foam abrasive cleaner to remove markers from child #1's (19 months) face, and forehead, resulting in a chemical burn to the child's face.
Plan of Correction: Administration verified that no Magic Erasers were or are within reach of children. All Magic Erasers that were stored in locked cabinets in classrooms were removed from classrooms. All Magic Erasers that were outside of packaging were thrown away. All Magic Erasers are now stored in the janitorial closet in their original packaging.
This licensing violation citation makes reference to a hazardous substance; though, Magic Erasers are not classified as a hazardous substance per the manufacturer's Safety Data Sheet (SDS).
Standard 8VAC20-780-340-A
When staff are supervising children, they shall always ensure their care, protection, and guidance.

On 3/4/2026, staff #1 used a melamine sponge/foam abrasive cleaner to remove markers from child #1's (19 months) face, and forehead. The child's face immediately turned red. Staff applied cold water to the child's face. The parent was called, who contacted poison control, and then consented for staff to apply an antibiotic ointment from the first aid kit. The parent arrived within 30 minutes to take the child for medical care where the child was identified as having a chemical burn to the face secondary to the use of the melamine sponge/foam abrasive cleaner on the child.
Plan of Correction: This incident was self-reported by the executive director. The incident was also reported to CPS. CPS declined to investigate. We conducted a review to ensure the employee involved was current on all mandatory trainings. The employee was current in those training and her professional qualifications exceeded those required for a lead teacher.
A review of our operating policies and procedures and emergency response plan was conducted. These documents cover proper use of toxic and chemical substances. A Magic Eraser is not classified as a hazardous substance per the manufacturer's Safety Data Sheet (SDS).
The employee was placed on administrative leave, pending the results of the licensing investigation. Once the preliminary investigation was complete, the employee was terminated.
All staff will go through a mandatory, synchronous refresher training on toxic substances use and storage prior to March 31, 2026.
