During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced inspection was initiated on 4/1/2025 and completed on 5/14/2025 in response to a complaint received by the licensing office on 3/26/2025 relating to allegations of operational responsibilities, children's records, behavioral guidance, and forbidden actions. The inspector reviewed 1 child?s record, 3 staff records and 1 household member record. This inspection included:
document review, tour of the facility, interviews, and observations.

The preponderance of evidence gathered during the investigation does not support the allegation(s); therefore, the complaint is determined to be not valid. Though not a part of the original complaint, violations that were not reported were found related to background checks, orientation training, ongoing training, tuberculosis screenings and are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 5/21/2025. A POC submitted after this date will not appear on the public website.

Systemic Violation

Providers are required to obtain a completed sworn statement prior to permitting an individual to serve as a volunteer who will be alone with, in control of, or supervising children.

Caregiver 4, who stated that they have been participating in the day to day operations of the
family day home for approximately 12 months by 1) interacting with parents and children in the morning and afternoon/evening, 2) assisting with and reviewing children's records, and 3) helping redirect and supervise children, does not have a completed sworn statement.
Plan of Correction: Sworn letter is already in place. Volunteer/caregiver 4 was never been alone while with children or being in control of supervision, children occasionally seeing children/parent sworn letter was already done.

Providers must obtain a completed national criminal background check prior to permitting an individual to serve as a volunteer who will be alone with, in control of, or supervising children.

Caregiver 4, who stated that they have been participating in the day to day operations of the family day home for approximately 12 months by 1) interacting with parents and children in the morning and afternoon/evening, 2) assisting with and reviewing children's records, and 3) helping redirect and supervise children, does not have a completed national criminal background check.
Plan of Correction: Provider was aware that caregiver 4's criminal background check was already done. Caregiver occasionally seeing the children and parents. Helps with interviews, follow up calls.

Caregiver 4, who stated that they have been participating in the day to day operations of the family day home for approximately 12 months by 1) interacting with parents and children in the morning and afternoon/evening, 2) assisting with and reviewing children's records, and 3) helping redirect and supervise children, did not have a central registry search requested.
Plan of Correction: Caregiver 4 central was already completed but on the day of inspection it was not available. Caregiver 4 help with interviews, follow up calls. Occasionally seeing the children/parents.

Assistants' and substitute providers' records shall contain all required documentation.

Caregiver 4, who stated that they have been participating in the day to day operations of the family day home for approximately 12 months by 1) interacting with parents and children in the morning and afternoon/evening, 2) assisting with and reviewing children's records, and 3) helping redirect and supervise children, did not have the following required documents on file: a. documentation of a tuberculosis screening, and b. documentation of training required by
8VAC20-800-230 to include orientation training and 16 annual training hours.
Plan of Correction: All of the required documents including documentation of training was already done, tuberculosis screening done too.
