During the inspection, the inspector reviewed the areas listed above. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced inspection was initiated and completed on 5/23/2025 in response to a complaint received by the licensing office on 5/22/2025 relating to allegations of Administration, Staff Qualifications and Training, Staffing and Supervision, Programs, Special Services. The inspector reviewed 1 child record and 4 staff records on-site. This inspection included documentation review, tour of the facility and interviews.

The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 6/3/2025. A POC submitted after this date will not appear on the public website.

Standard 22.1-289.035-B-1
The center is required to obtain a completed sworn statement prior to the employee's first day of employment.

The record for Staff C, employed for 3 months, did not contain a sworn statement.
Plan of Correction: Sworn Statement signed and completed.
Standard 8VAC20-780-160-C
(REPEAT VIOLATION) A tuberculosis (TB) screening is required every two years from the last screening.
1. Staff A updated TB Screening was overdue by 5 months.
2. Staff B updated TB Screening was overdue by 5 months.
Plan of Correction: Staff A and B are in the process of completing their TB screening.
Standard 8VAC20-780-240-C
Staff shall complete orientation training in subsection C of this section prior to the staff member working alone with children and no later than seven days of the date of assuming job responsibilities.

The record for Staff A, employed for 3 months did not contain documentation of completed orientation training.
Plan of Correction: Staff member A is in the process of completing training.

Each grouping of children shall have at least one staff regularly present who meets lead teacher qualifications.

Staff C, who was stated to be the lead teacher for the Gators Classroom, did not have documentation on file to show that they met lead teacher qualifications.
Plan of Correction: Staff C has a 4 year degree from her country. She is in the process of obtaining her transcripts. Until then, she has also enrolled in classes to obtain her lead teaching certificate.

The required ratio for children ages 3 years up to school age is one staff per 10 children.

Staff D was observed supervising 12 children (youngest child 4 years old) in the classroom alone for approximately 2 minutes.
Plan of Correction: Staff D was out of ratio briefly but once recognized, the ratio was corrected.
Standard 8VAC20-780-560-F
A menu listing foods to be served for meals and snacks during the current one-week period shall list any substituted food.

On 5/23/2025, the center did not serve what was listed on the menu posted for parents. The center sent out a notification to parents of calendar events and stated 5/23/2025 would be breakfast for lunch. The center did not detail what they planned to serve the children on 5/23/2025.
Plan of Correction: Staff will make sure that any changes will be listed out for parents to see, as
well as emailed.
Standard 8VAC20-780-80-A
For each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.

The Sharks classroom had 4 children present, but only 3 children were signed in the daily attendance.
Plan of Correction: Staff has been counseled on making sure each child is signed in. It should be
noted that attendance for each child that enters the building is manually entered on our attendance log kept at the front desk.
