Inspector Notes

An unannounced inspection was initiated on 3/21/25 and completed on 4/9/25 in response to a complaint received by the licensing office on 3/18/25 relating to allegations of staffing and supervision, programs, special care provisions and special services.

The inspector reviewed 1 child's record on site. This inspection included document review, tour of the facility, interviews and observations.

The preponderance of evidence gathered during the investigation does not support the allegation(s); therefore, the complaint is determined to be not valid. Though not a part of the original complaint, violations that were not reported were found related to administration and background checks and are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 4/16/25. A POC submitted after this date will not appear on the public website.

Standard 22.1-289.035-B-1
Repeat Violation:
A sworn disclosure statement disclosing whether staff have ever been convicted of or is the subject of pending charges for any offense within or outside the Commonwealth and whether they have been the subject of a founded complaint of child abuse or neglect shall be completed prior to employment or service.

Person A did not have a sworn disclosure statement on file at the time of hire. This was Person A's first day on the job.

A national fingerprint background check is required prior to employment.

An employee may begin employment without having their central registry check as long as the sworn disclosure statement and the national fingerprint background check has been obtained and the central registry background check has been requested at the time of employment and the staff is supervised at all times by an individual with all required background checks completed within the last five years.

The central registry background check had not been requested and Person A was unsupervised and left alone with five preschoolers.

Standard 8VAC20-780-40-N
The center shall develop written playground safety procedures which shall include provision for active supervision by staff to include positioning of staff in strategic locations, scanning play activities and circulating among children.

On 3/21/25 two staff were located at the top of the playground, one staff was sitting in a chair while several preschoolers were at the lower part of the plagyorund hiding behind a tree. The staff were not positioned on the lower level of the playground nor was the staff circulating in the areas populated by the children.

Staff records shall be kept for each staff person to include but not limited to their emergency contact information, references, tuberculosis test, documentation of their educational and experience required by the job, orientation training, health information, policies and procedures provided in writing etc.

There was no file created on Person A, who was at the center as a volunteer but was functioning as a staff as they were left alone supervising children.
