Provide a sworn statement or affirmation disclosing whether he has ever been convicted of or is the subject of pending charges for any offense within or outside the Commonwealth and whether he has been the subject of a founded complaint of child abuse or neglect within or outside the Commonwealth.

A sworn statement had been completed but it was not completed before the hire date as required.

Each child day program that is licensed pursuant to this chapter and any program described in subdivision A 4, B 1, or B 5 of ? 22.1-289.030 that serves preschool-age children shall develop and implement a plan to test potable water from sources identified by the U.S. Environmental Protection Agency as high priority, including bubbler-style and cooler-style drinking fountains, kitchen taps, classroom combination sinks and drinking fountains, home economics room sinks, teacher's lounge sinks, nurse's office sinks, classroom sinks in special education classrooms, and sinks known to be or visibly used for consumption.

The provider has not developed or implemented a plan for testing.

Hot water taps available to children shall me maintained within a range of 105 F and 120 F.

The water temperature in the bathroom that the children use was 124 degrees.

All animal excrement shall be removed promptly, disposed of properly, and, if indoors, the soiled area cleaned.

Animal excrement was around and near the path to enter the family day home.

Infant carrier seats, swings, strollers, feeding or activity tables, and high chairs shall be used according to the manufacturer's instructions and when occupied by a child, a safety strap shall be used and securely fastened.

An infant was observed in a high chair without the strap used and securely fastened.
