Standard 22.1-289.035-B-1
The center is required to obtain a completed sworn statement prior to the employee's first day of employment.
1. The sworn statements for staff #1, staff #3, staff #5, staff #7, staff # 10, staff #11, and staff #14 were dated three days after their first day of employment.
2. The sworn statement for staff #2 was dated over six weeks after their first day of employment.
3. The sworn statement for staff #6 was dated seven days after their first day of employment.
4. The sworn statement for staff #9 was dated eight days after their first day of employment.
Plan of Correction: To prevent future documentation discrepancies, the center has implemented several corrective measures. Sworn statements must now be signed, dated, and filed prior to an employee participating in orientation. Administrative staff have been retrained on proper documentation procedures and the importance of maintaining the original date of completion. Additionally, a pre-orientation compliance checklist has been added to every staff file to verify that all required documents are completed in the correct order.

The center must obtain a completed national criminal background check prior to the employee's first day of employment. Staff #2, staff #3, staff #4, and staff #5, did not have fingerprint results prior to employment. Staff #2, had been employed over a month, staff #3 had been employed over three weeks, staff #4 had been employed over a week, and staff #5 had been employed for two days before fingerprint results were obtained. Each of these staff completed orientation training on 8/5/25.
Plan of Correction: To ensure clarity and compliance moving forward, the center has strengthened internal procedures regarding pre-employment documentation. A mandatory verification checklist has been implemented to confirm that all background check results are received before assigning a hire date or allowing participation in any center activities, including orientation.

Systemic Violation
The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department. The center is required to follow its own policy on medications. The parent handbook states that prescription drugs and other medications must be properly labeled with the child's name and dosage and that Over-the Counter medications must follow the manufacturer's instructions for age, dosage, and duration. On October 27, 2025, an incorrect dosage of over-the-counter medication was administered to child #6 (age 2 years). The medication was not labeled with the dosage and duration and the manufacturer's instructions were not followed.

Systemic Violation
The center's procedures for administering nonprescription medication, shall be consistent with the manufacturer's instructions for age, duration, and dosage. Staff #15 did not follow the manufacturer's instructions when the staff administered an incorrect dosage of children's ibuprofen higher than the manufacturer's instructions, to child #6 (age 2 years).

Medication shall be labeled with the child's name, the name of the medication, the dosage amount, and the time or times to be given. Medication for child #6, was not labeled with the dosage amount and time or times to be given.

Systemic Violation
If diaper ointment or cream is used a record shall be kept that includes the child's name, date of use, frequency of application and any adverse reactions. Staff #11 stated diaper spray gel was administered several times to child #7 and there was no record kept.
