During the inspection, the inspector reviewed the areas listed above. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced monitoring inspection was initiated November 18, 2024 and completed on November 19, 2024 in response to a self-report received by the licensing office on November 4, 2024 relating to behavioral guidance and forbidden actions. The inspector reviewed four staff records on-site on November 18, 2024. This inspection included document review and interviews. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program. Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five business days from today, which will be the close of business December 5, 2024. A POC submitted after this date will not appear on the public website.

Standard 8VAC20-780-40-E
The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
Staff #1 did not follow the center's discipline policy which states: The goal of positive discipline is to help children build their own self-control so that they may share, cooperate, handle their emotions, and feel successful and in control of themselves. This is accomplished by guiding children to identify their emotions and select acceptable alternatives to their misbehavior. Teachers model appropriate ways children can solve their problems and help children practice these various positive techniques. Teachers use intentionally positive language to emphasize appropriate choices for the child, rather than focusing on the negative behavior.
On October 31, 2024, Child #1 refused to clean-up, staff#1 jerked/dragged the child by the shoulder.
Plan of Correction: We will retrain our staff and give written reminders about our positive discipline policy. We will continue to seek legal counsel when needed.
Standard 8VAC20-780-400-B
Behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.
On October 31, 2024, when child #1 refused to clean-up, staff #1 jerked/dragged the child by the shoulder, leaving a red mark.
Plan of Correction: Staff #1 was terminated on 10/31/2024. We will retrain staff on our positive discipline policy.
Standard 8VAC20-780-410-1
Actions such as physical punishment, striking a child, or roughly handling or shaking a child are forbidden.
On October 31, 2024, staff #1 grabbed child #1's shoulder and jerked/dragged the child leaving a red mark. Child #1 said staff #1 was hurting him.
Plan of Correction: At our next staff meeting staff training day, we will retrain staff on our positive discipline policy. A written reminder was sent to staff on 12/2/2024.
