Inspector Notes

A complaint inspection was conducted on 07/19/2023 to investigate a complaint received by the department involving the area of forbidden actions. During the investigation, interviews were conducted with staff, and documents, video footage and staff/child records were reviewed.

Based on the the evidence gathered during the investigation, the complaint was determined to be not valid. Areas of non-compliance related to the area of supervision are listed on the Violation Notice. Based on observation of video footage and review of documents provided by the center, it was determined that staff did not ensure care, protection, and guidance when supervising children.
Evidence:
1) On the video footage from Room 12, it was observed that on 05/19/2023, three staff persons were in the 3 year-olds room positioned in different areas of the room while the children were moving around freely. Child #1 and two other children were observed playing roughly (pushing each other, running, jumping). One staff member walked by the group of children and did not address the behavior nor redirected the children to a different activity. Approximately 2 minutes later, one of the children pushed Child #1, resulting in Child #1 tripping and hitting his chin on a table corner. Out of the three staff in the room, none is seeing in the video directly supervising these three children.
2) Copies of Corrective Action Forms dated 05/22/2023 and addressed to each of the three teachers in the room state that "teachers continued to engage in transition duties and failed to provide proper behavior management and oversight of the three boys".
Plan of Correction: A meeting was conducted to review footage of the incident, discuss program policies and procedures particularly as they relate to proper supervision. Curriculum Coordinator visited the classroom and provided mentoring for teaching staff to improve schedule of activities and routines and enhance supervision.
