Inspector Notes

An unannounced complaint inspection was conducted on 04/22/2024 in response to allegations received by the licensing office on 04/18/2024 in the areas of forbidden action and special care provisions. A total of 1 child?s record, and 1 staff record was reviewed. The inspector arrived for the inspection at approximately 10:15 am and departed at approximately 1:15 pm.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

The information gathered pursuant to an investigation of the complaint supports the allegation and the complaint was determined to be valid.

COMPLAINT RELATED
Based on interviews with staff and the review of photographic evidence, the center failed to ensure that actions towards children that are forbidden by the standards (physical punishment, striking a child, roughly handling or shaking a child) were not used at the center.

Evidence: During the review of photographic evidence, Staff 1 confirmed that the bruising that can be seen in the photograph on the arm of Child 1 was made by them on 04/09/2024. Staff 1 stated that the bruise was the result of holding Child 1?s arm in an attempt to keep Child 1 from hurting themselves.
Plan of Correction: 1. Staff will continue to care for children in a manner to prevent children from hurting themselves.
2. In this attempt to protect children from harming themselves, staff shall not use any protective method that would be considered roughly handling.

COMPLAINT RELATED
Based on interviews of staff, the center failed to maintain a written record of children?s injuries in which entries are made the day of occurrence and contain all of the elements as required by the standards.

Evidence: Staff 1 and Staff 3 confirm that no written injury report was maintained for the injury sustained to Child 1 on 04/09/2024.
Plan of Correction: 1. Staff will continue to inform parents/guardians either verbally and/or in writing of all injuries to their child.
2. Staff will ensure that even when parents have been informed of a child?s injury, staff will submit a written report to the center director.
