Inspector Notes
An unannounced monitoring inspection was conducted on 11/16/2023 from 9:50 am to 1:22 pm. There were 51 children in care, ages 18 months to four years, in six groups under the care of ten staff. The Licensing Inspector reviewed five children?s records, two medications and associated records, five staff records, two licensee background checks, and other program records. The children were observed on the playground, quiet activities, and playing inside. There was a discussion regarding medication permission. If the center is going to administer medications, written authorization from the parent and/or the physician must be obtained prior to administering it. If there is no permission the medication must be returned to the parent, or the center must dispose of it within 14 days of expiration of authorization. Please see regulations 8VAC20-780-510-B, E-3, I-2, and P. There was a discussion of custodial parent rights, and the need for court papers to document lack of custodial rights.
Based on discussion with licensing administrator, the inspection documents were amended. A section of evidence was removed from one violation.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.
Violations
5Based on record review, the center failed to obtain out-of-state Child Abuse and Neglect checks within 30 days of hire and out of state criminal record checks prior to hire for new staff.
EVIDENCE:
1. Staff 1 has a documented hire date of 7/31/2023 and the sworn disclosure statement shows they lived in two other states within the past five years. The center does not have the criminal record check for one of the states (PA).
2. Staff 2 has a documented hire date of 11/7/2023 and the sworn disclosure statement shows they lived in another state within the past five years. The center does not have a criminal record check for that state (SC).
EVIDENCE:
1. The most recent Fieldprint fingerprint check for Licensee 1 was done 9/4/2018.
2. The most recent Fieldprint fingerprint check for Licensee 2 was done 6/19/2018.
Based on record review, the center failed to obtain a TB screening on a new staff member that was done within at the time of employment or 30 days prior to employment, and prior to coming into contact with children.
EVIDENCE:
The documented hire date for Staff 1 was 7/31/2023 and their TB screening was dated 6/27/2022.
EVIDENCE:
1. The documented hire date for Staff 1 was 7/31/2023 and the VDOE-sponsored orientation course has not been completed.
2. The documented hire date for staff 4 was 6/26/2023 and the VDOE-sponsored orientation course has not been completed.
EVIDENCE:
Staff 1 and 3 were caring for a group of eight children in the 16-month to two-year old class. Staff 1 identified themselves as the lead. The records of neither Staff 1 nor 3 have documentation to show they are qualified to act as program leads.
