Inspector Notes

An unannounced monitoring inspection was conducted on 05/02/2023. There were 26 children, ages 5 years- 11 years, and 4 staff members providing direct care present during the inspection. The inspector reviewed compliance in the areas of administration, staff qualifications and trainings, staffing and supervision, physical plant, programs, emergencies and nutrition. The inspector discussed the following with provider: food from home. The children were observed during arrival, mealtime, and homework time. A total of 5 children?s records, 4 staff records and 2 medications were reviewed. The inspector arrived for the inspection at 3:15 pm and departed at 4:45 pm.
The information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation noticed issued to the provider.

Based on observations and interviews with staff, the center failed to ensure that all employees shall undergo a background check in accordance with the Code of Virginia prior to employment or beginning to serve as a volunteer and every five years thereafter.
Evidence:
1. The most recent employment eligibility letter for Staff 1 was dated 02/23/2018. There was no 2023 employment eligibility letter available for review during the inspection. Staff 1 confirmed there was no 2023 employment eligibility letter available for review during the inspection.
2. The most recent employment eligibility letter for Staff 4 was dated 02/13/2018. There was no 2023 employment eligibility letter available for review during the inspection. Staff 1 confirmed there was no 2023 employment eligibility letter available for review during the inspection.
Plan of Correction: Staff made appointments to obtain fingerprints during the inspection.
Standard 8VAC20-770-60-B
Based on record review, the center failed to ensure that an employee must not be employed until the agency has the person?s completed sworn statement or affirmation.
Evidence: The record for Staff 2 contained a documented hire date of 01/12/2022. The sworn statement was dated 01/31/2022.
Plan of Correction: Provider will obtain required information prior to hire.
Standard 8VAC20-780-160-A
Based on record review, the center failed to ensure that each staff member shall submit documentation of a negative tuberculosis screening at the time of employment and prior to coming into contact with children and the documentation shall have been completed within the last 30 calendar days of the date of employment.

Evidence:
1. The record for Staff 2 contained a documented hire date of 01/12/2022. The documentation of a negative tuberculosis screening was dated 02/11/2022.
2. The record for Staff 3 contained a documented hire date of 06/13/2022. The documentation of a negative tuberculosis screening was dated 08/28/2022.
