Inspector Notes

Licensing Inspector Anderson conducted an unannounced complaint inspection in response to allegations received by the licensing office on November 29, 2023, in the area of sight and sound supervision. The investigation of the complaint was initiated on November 30, 2023 and findings were reviewed on January 8, 2024.

As the information gathered during the investigation support the allegations, the complaint is determined to be ?VALID.? The inspection findings have been updated as a result of a first step problem solving conference completed on 2/8/2024.

Standard 8VAC20-780-140-A
Based on record review, the center failed to have physical examination documentation for each child enrolled.

EVIDENCE:
Record for Child #1 did not include a physical examination before the child?s 1st day of attendance (8/10/2020) nor within 30 days after the first day of attendance
Plan of Correction: Subject to and without waiving the above stated objections to the Violation Notice, Honeytree has taken the following action:

? Administrative staff was in-serviced on this regulation and the records for Child #1 were brought into compliance.
Standard 8VAC20-780-340-A
Based on interviews, record review, and inspection, the center did not ensure that when staff are supervising children, they shall always ensure their care, protection and guidance.

EVIDENCE:

1. On 11/28/2023, Staff #1 allowed Child #1 (age 3 years) to leave the classroom alone to go to the bathroom down the hallway. Without any staff supervision, Child #1 left the bathroom, went down the hallway, and exited the building into the parking lot alone. The parking lot is next to a two-lane road with a speed limit of 35 miles per hour.

2. The center?s bus driver reported that they pulled into the parking lot, at nearly the same time as the child?s parent, and saw the child standing alone inside of the front door of the center. The child exited the building and walked alone into the parking lot of the center.

3. The child?s parent reported that the child was in the parking lot as she was pulling into the lot.
Plan of Correction: Subject to and without waiving the above stated objections to the Violation Notice, Honeytree has taken the following action:

? Staff #1 was in-serviced on this regulation on November 30, 2023, following the DSS investigation to include a review of Active Supervision training materials and Classroom Management training materials.

? Staff #1 completed an Employee Counseling Report related to this specific violation.
Standard 8VAC20-780-340-F
Based on interviews and record review, the center did not ensure that children under 10 years of age shall always be within actual sight and sound supervision of staff.

EVIDENCE:
1. On 11/28/23, Staff #1 allowed Child #1 (age 3 years) to leave the classroom alone to go to the bathroom down the hallway. After leaving the classroom and without any sight and sound supervision from staff, Child #1 entered and left the bathroom, walked down the hallway, stood at the front door, and exited the building alone into the parking lot of the center.

2. The center?s bus driver reported, with a written statement, that they pulled into the parking lot, at nearly the same time as the child?s parent, and saw the child standing inside of the front door of the center. The child exited the building alone to the parking lot of the center.

3. The child was not in sight and sound supervision of staff for an estimated time of approximately five to 15 minutes.
Plan of Correction: Subject to and without waiving the above stated objections to the Violation Notice, Honeytree has taken the following actions:

? Staff #1 was in-serviced on this regulation on November 30, 2023, following the DSS investigation to include a review of Active Supervision training materials and Classroom Management training materials.

? Staff #1 completed an Employee Counseling Report related to this specific violation.

Based on record review, the center upon enrollment of a child, failed to require information regarding proof of the child?s age and identity.


EVIDENCE:
Record for Child #1 (date of enrollment 8/10/2020) did not include evidence that the child?s proof of age and identity was reviewed/confirmed.
Plan of Correction: Subject to and without waiving the above stated objections to the Violation Notice, Honeytree has taken the following action:

? Administrative staff was counseled and in-serviced on this regulation, and the records for Child #1 were brought into compliance.
