During the inspection, the inspector reviewed the areas listed above. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced monitoring inspection was initiated on 9/9/24 and completed on 9/9/24 with the local agency in response to a self-report received by the licensing office on 9/3/24 relating to behavioral guidance. The Department requested that the provider complete an Intensive Plan of Correction (IPOC) as a result of an inspection on 5/30/24 related to staffing and supervision. The inspector reviewed 1 children?s record and 2 staff records on-site on 9/9/24. This inspection included document review, interviews and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 10/14/24. A POC submitted after this date will not appear on the public website.

Standard 8VAC20-780-400-A
Staff shall interact with the child and one another to provide needed help, comfort and support.

Multiple staff reported witnessing numerous incidents in the infant classroom of staff 1 interacting with children in ways deemed inappropriate and not conducive to promoting the children?s physical well-being and growth. Staff admitted that they failed to intervene or provide help and support at the time of these incidents and did not report staff 1?s inappropriate interactions with children to center management.
Plan of Correction: The center responded with the following: All teachers have been retrained on Child Abuse and Neglect Prevention and Reporting Guidelines. The policy defines what is child abuse and neglect and what the signs are. Policy also includes phone number to hotline for mandated reporting.

Repeat Violation
Behavior guidance shall be constructive in nature and age and stage appropriate.

1. Multiple staff reported witnessing staff 1 make numerous statements to child 1 (age 14 months) that she was going to ?pop? him and that his mother gave her permission to do. Staff 1 admitted to saying on several occasions while caring for children in the infant classroom that she could ?pop? child 1 if she wanted to because the child?s mother said she could do so. Staff 1 stated she said this in a joking manner but admitted that these statements were not age and stage appropriate or constructive in nature.
2. Staff 2 reported that on 8/30/24, she witnessed staff 3 tell a child in the pre-K classroom ?I am going to punch you in the face? while making a fist with her hand and pulling her arm back as if to punch the child. Staff 2 stated staff 3 had a serious tone to her voice when speaking to the child and was not laughing. Staff 2 reported that staff 3 admitted to telling a child that she was going to punch him and stated she was ?joking? and that ?that?s how we play? in the classroom.
Plan of Correction: The center responded with the following: We have retrained all staff on our OP-300 policy which is for Guidance, Protection of and Respect for Children. This policy states the employee should use only positive guidance, such as redirection, praise and modeling of pro-social behavior, setting clear expectations and classroom rules and verbal interventions. This policy includes that employees must adhere to all applicable state and local laws governing child guidance or discipline. District Leader came following the incident and did one on one coaching conversations with every member of staff for understanding of expectations for child guidance as well as mandated reporting.
