Inspector Notes

This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring inspection was initiated and concluded on 5/11/21. The director was contacted by telephone to initiate the inspection. There were 22 children and 6 staff present. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 2 children?s records and 2 staff records submitted by the facility to ensure documentation was complete. Additional center documents were also reviewed. Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility. The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs. Standard 22VAC40-185-60-A
Based on records review, a child's record was not complete.
Evidence: Child # 1's record was missing the first day of enrollment.
Plan of Correction: The first date of enrollment will be added to the record.
Standard 22VAC40-191-60-C-2
Based on records review, the center did not obtain results of and out of state central registry finding within 30 days of employment.
Evidence:
1. Staff # 2's hire date was 3/5/21.
2. The center did not obtain Staff # 2's results of the VA central registry finding within 30 days of employment.
Plan of Correction: Staff # 2 is no longer employed at the center. We will submit background searches on time.
Standard 63.2(17)-1720.1-B-4
Based on records review, the center did not obtain results of an out of state central registry search for an employee that resided outside of Virginia within the last 5 years; the center did not obtain results of the out of state sex offender search for existing employees by 12/31/20; the center did not obtain results of the out of state sex offender search for new employees before the first day of employment; and the center did not obtain results of the out of state criminal history search for a new employee before the first day of employment.
Evidence:
1. Staff # 1's hire date was 7/31/20. Staff # 1's out of state sex offender search for North Carolina was not completed by 12/31/20, and was dated 4/5/21.
2. Staff # 2's hire date was 3/5/21. Staff # 2's record indicated that she resided in D.C. and Maryland within the last 5 years.
3. Staff # 2's out of state sex offender search for D.C. and Maryland was not completed before the hire date, and was dated 4/28/21.
4. Staff # 2's out of state central registry search for Maryland was not completed within 45 days of employment.
5. Staff # 2's out of state criminal history check for D.C. was not obtained before or after the first day of employment.
Plan of Correction: We will submit requests for background checks on time. Staff # 2 is no longer employed with the center.
