Inspector Notes

This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.

A monitoring inspection was initiated and concluded on November 12, 2021. The director was contacted by telephone and a virtual inspection was conducted. There were 48 children present, ranging in ages from 5 months to 4 years old, with 10 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of four child records and four staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Based on record review and interview, the center did not obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
Evidence:
1. Staff #1's record (Date of hire-06/21/2021) did not contain an out of state criminal background check for a state that the staff member resided in the last five years. Staff #1 lived in the state of Texas in the last five years per Sworn Disclosure Statement dated 06/16/2021. A Texas Sex Offender Search and Texas Central Registry was conducted.
2. Staff #5 confirmed that a criminal background check for the state of Texas was not conducted.
Plan of Correction: A Texas Criminal Background Check was conducted the day of the inspection and rendered no results for the staff member. Out of State background checks will be conducted and received before an employee is hired.
